In a setback to the Kejriwal dispensation, Lt Governor Anil Baijal has
directed that Rs 97 crore be recoverd from AAP that was allegedly
"splurged" by the city government on advertisements in violation of
the Supreme Court guidelines.

The AAP will have to reimburse the money within a month. The move
comes months after a Centre-appointed three-member committee indicted
the AAP government for "misusing" exchequer money on advertisements.

Sources told PTI that out of Rs 97 crore incurred on advertisements,
government has so far paid Rs 42 crore to ad agencies and the LG has
directed Chief Secretary M M Kutty to get the amount reimbursed from
the AAP. The rest Rs 55 crore, which is yet to be paid by the Kejriwal
government, would be given by Aam Aadmi Party to the ad agencies,
according to the the LG's directions.

Last year, the three-member committee, headed by former Chief Election
Commissioner B B Tandon, had been constituted by the I&B ministry on
directions of the Supreme Court to address issues related to Content
Regulation in Government Advertising.

The story

 

One Kamal didi ( she signs as Kamal didi too) of the Rashtriya Mahila Gau Rakshak Sewa Mandal was trying to catch stray cows with the help of the nagar nigam to take them to the Gau shalas, when Qasim a cleaner boy from Rabbani Hotel came to throw garbage in an empty plot near the dustbin on Kanti Chandra road. All the hoteliers and other private residents throw garbage there. Some of the stray cows who were hanging out near the kachra, (The stray cow population of the city is always hovering near dustbins, as they are very hungry) immediately went for the freshly thrown bags, which had food waste along with some chicken / mutton bones.

Kamal Didi immediately started thrashing Qasim that he was trying to pollute the cows with beef and dragged and him and brought him to the hotel, with 15 other of her followers. Very Soon more than a hundred people joined them later, all wanting Rabbani to come out. The police was called that beef was being Cooked and served in this hotel. The police and the media came together. The Gau Rakshaks are always with the media. When they could not find Rabbani, they picked up Wasim the receptionist and the cleaner and booked them under section 151 CrPC and arrested them. At the hotel they found brouchres on the activities of the SIO (the Jamaat Student wing), writings of Maulana Wahauddin and the communal HARMONY campaign literature of JAmait ISlami hind , so the police reached the JAmaat office asking for Naeem Rabbani. When they learnt that he was not there, they went to his house and as said by filmstar Ajeet's in his famous dialogue "uski ma, behen ko utha lao", they picked up the brother in law Abdul Rehamn, who had nothing to do with the hotel. Which is when people got in touch with me.

 I rushed to the Sindhi camp police station, the police let the brother in law go, it was only on our way out that we learnt that they had picked up two others of the hotel, after dropping Abdul Rehman safely to his relatives, we went back to the police station to meet the other two and get them out. But the police told us that they had been booked and arrested. They would be produced in front of a magistrate and restrained.

 What is interesting is that the protest over the hoax cry that beef was being cooked, resulted in police taking the meat samples and also the Jaipur Municipal corporation sealing the hotel. They got all the guests out and sealed it. What is sad is that Hyatt Rabbani has been getting awards regularly from the hoteliers association for good service among the other things. Now the hotel is closed. Rabbani is being asked to show up in the morning and will also be restrained under sec 151, Cr PC.

 The Muslim community leadership is in a state of shock as to how could the police come under pressure and book Rabbani and pick up his staff over just an allegation of beef being cooked and served when it was all false. They are very upset. The electronic media, has kind of declared that the meat samples were of suspicious nature. Did not seem mutton or chicken.

So even before Yogi Adityanath takes over as UP CM, the rest of their lot are so emboldened that they take no time in declaring a Muslim who runs a hotel as committing blasphemy. Some were also sure that this was done by the next door hotelier who was threatened by their booming business. The ward councillor Nirmala Sharma was also there. Who was directing the JMC staff to seal the hotel. While this was being done, the crowds were shouting Jai Shree Ram. Infact, Jai Shree Ram and other slogans were constantly being raised in the drama which lasted 4 and a half hour. From 6pm to 10.30pm

 Qasim and Wasim are spending the night in the police station, Hopefully should be released tomorrow. Rabbani not knowing what has hit him, he was just working hard and doing business, is now preparing to face the police. His friends and other members of the Muslim community kept saying that all over Jaipur people are throwing garbage as there are not even garbage bins, why take action against us only. When I told this to a senior police official he said we only act somebody complains.

This is not the first beef related case in Rajasthan. On 30th May 2015 in village Birloka, Khimsar Tehsil, Nagaur District 60-year-old Abdul Ghaffar Qureshi was lynched by a mob for no fault of his. Simply because a rumour spread that Muslims had killed more than 200 cows for a feast and pictures of the carcasses started circulating on social media. Young men in thousands gathered  in the fields of Kumhari village wherethe  carcasses were lying as the  municipality contractor had rented the field to dispose of a cattle carcass, as a routine municipal exercise, hate speeches and protests took off all over and before one knew Abdul Ghaffar Quereshi who had nothing to do with the incident was beaten with iron rods and killed in the market place, despite some of his Hindu neighbours trying to help him. The hate speech had provoked the neighbourhood to just kill the man as there wanted him out of the village.

 

 The PUCL condemns this attack by the police and Kamal Didi  who have maligned the name of Naeem Rabbani and appeals to the Police Commissioner Jaipur, Sanjay Agarwal to stop this attack on the hotelier and his business. The DCP west and the local police need to be charge sheeted for acting against Rabbani under pressure of the Gau Rakshaks and the ward Councillor. Also the JMC who sealed the hotel for no reason under pressure from the ward counciloorw

The Central Information Commission has published the Annual Report for 2015-16 regarding the implementation of The Right to Information Act, 2005 (RTI Act). This Annual Report (AR) may be accessed on its website. I thank Commodore (retd.) Lokesh Batra for alerting us about the publication of this AR on the CIC's website today.

Our quick analysis of the statistics and issues highlighted in the Annual Report is given below.


Central Government- Overall RTI Trends for 2015-16
1) During the reporting year 2015-16 9.76 lakh RTI applications were said to have been received by the registered public authorities (PAs). This is 2.21 lakhs or 22.67% more RTI applications received than what was reported during 2014-15. However in 2014-15 almost a quarter of the registered PAs failed to submit their RTI stats. Only 75.27% of the PAs reported their RTI stats to the CIC. So the data for 2015-16 indicates that the number of RTIs filed with the PAs in GoI continues to display a plateauing trend this year as well with no significant hike in the numbers. However the CIC reports that RTI applications have increased by 3.8% in 2015-16 as compared to the previous year.

2) According to the CIC the PAs rejected 6.62% of the RTI applications processed during 2015-16. This seems to have come down by 1.77% from the high of 8.39% reported in 2014-15. Nevertheless the figure for 2015-16 is much higher than the lowest proportion of rejection recorded in 2010-2011 at 5.10%. However the downward trend in 2015-16 appears to be a positive development. 

3) According to the CIC, the highest proportion of RTI applications was rejected not under the permissible exemptions under the RTI Act such as Sections 8, 9, 11 or 24 but under the mysterious category of "others". At 43% rejections recorded under this category, more than 4 out of every 10 RTI applications rejected were for reasons other than those permitted by the RTI Act. The Prime Minister's Office is one of the PAs that employed this device very frequently (see ministry-wise findings below).

4) 47% of the 9.76 lakh RTIs were rejected under various clauses in Section 8 of the RTI Act. 1% of the RTIs were rejected under Section 9 (private copyright) and 7% of the RTI were rejected by the 26 security and intelligence organisations partially excluded under Section 24 of the RTI Act.

5) The CIC has reported that there is a decrease in the number of first appeals received but increase in the number disposed by the first appellate authorities. While this is a new positive trend, it requires deeper analysis because in previous years the proportion of first appeals has often been higher than the proportion of rejections.

6) The CIC disposed of 28,188 appeal and complaints cases in 2015-16 while 25,960 cases were registered during the same period. Pendency of second appeals and complaints on 01 April, 2016 was a whopping 34,982 cases.

7) The CIC reports that it imposed penalties to the tune of Rs. 10.52 lakhs out of which Rs. 9.41 lakhs was paid up by the PIOs. Penalties worth Rs. 1.25 lakhs imposed in various cases have been stayed by various High Courts.

8) The CIC has reported that the amount of fees and penalties reported by the PAs has increased by 12.31% in 2015-16. However if the amount of penalty imposed is reduced from this figure, the amount of fees collected by various PAs has actually come down from Rs. 1.14 crores in 2014-15 to Rs. 1.07 crores in 2016-17. This trend seems to be at variance with the reduction in the proportion of rejections. This is because, if more people received information then logic dictates that the proportion of fees collected ought to have gone up. This would have to be the case unless the PAs have started the practice of giving information free of charge to RTI applicants. This new trend requires deeper examination.

9) The number of Public Authorities registering with the CIC for submitting their RTI statistics is 1,903 - much lower than the highest figure of 2,333 registered in 2012-13. More than 400 public authorities did not register with the CIC despite its perseverant efforts in 2015-16. However, the AR states that reporting compliance from amongst the registered public authorities is the highest during the last 12 years at more than 94%. This is a good sign. However, the report does not throw light on the names of public authorities that did not register with the CIC. This could have been done by comparing with the data from 2012-13.

10) The Ministry of Drinking Water and Sanitation and Ministry Overseas Indian Affairs have not reported their RTI statistics despite registering with the CIC. Only 33% of the public authorities from the Ministry of Road Transport and Highways reported their RTI Stats to the CIC. However compliance has been between 60-100% in a large number of Ministries and Departments that have registered with the CIC.


RTI Trends of select constitutional authorities and Ministries
Please see the attached MS Excel file for the tabulated data from 2005 to 2016 for these select constitutional authorities and Ministries:

1) While the President's Secretariat received only 123 more RTIs in 2015-16 as compared to the previous year the proportion of rejection plummeted from 9.30% to 1.2% in 2015-16. This appears to be a very significant positive trend indicating higher proportion of information disclosure.

2) In 2015-16 the Prime Minister's Office (PMO) reported a rejection rate of 20.10% of the RTIs received. This is a significant drop from 22.10% in 2014-15. However only 7 RTI applications were rejected by the PMO invoking Section 8. A whopping 2,227 RTIs were rejected in the "Others" category. However rejections in this category were much higher at 2,781 in 2014-15. This declining but nevertheless worrisome trend requires in-depth study.

3) The proportion of rejection of RTIs by the Supreme Court fell to 21.1% in 2015-16 while it received only 6 more RTIs as compared to the previous year. The proportion of rejections by the Delhi High Court also registered a fall of more than 1% in 2015-16 even tough the number of RTI received went up by 127.

4) While the number of RTIs received by the Comptroller and Auditor General fell to 716 in 2015-16 from 796 the previous year, the proportion of rejection zoomed to 17.2% from 6.3% reported the previous year. This alarming increase requires in-depth study.

5) The proportion of rejection of RTIs by the Election Commission of India has remained at steady state at 0.1% despite receiving 539 fewer RTIs in 2015-16.

6) The Cabinet Secretariat also witnessed a jump in the proportion of rejections from 4.30% to 6.65% in 2015-16 although it received only 73 more RTIs. 

7) The Ministry of Personnel and Training reported a significant decline in the proportion of rejections at 3.4% in 2015-16 as compared to 9.4% during the previous year even though it reported receiving 9,000 more RTIs in 2015-16. This appears to be a positive trend.

8) Although Delhi Police received 648 more RTIs in 2015-16, the proportion of rejection fell slightly by 0.4% in 2015-16.

9) Among key Ministries, the proportion of rejection in the Ministry of Defence fell significantly to 11.5% in 2015-16 as compared to 15.90% the previous year. In the Ministry of Finance which has 212 PAs reporting (banks and tax authorities), the proportion of rejection fell to 18.30% in 2015-16 as compared with the 20.20% rejection rate the previous year. The Ministry of External Affairs also reported a fall in the proportion of rejection at 5.74% in 2015-16 as compared to the 7% rejection rate reported the previous year. However, the proportion of rejection in the Home Ministry increased slightly by 0.1% in 2015-16 even though it received 1,143 more RTIs in 2015-16. 

CHRI will analyse the trends for other key public authorities in the coming days. This preliminary analysis is being circulated to readers on the day of uploading the CIC's Annual Report for 2015-16.

That's one way to look at the poll results. Another way is that their vote share dropped from appx 24% during Lok Sabha elections to 19% appx.
Why I subscribe to the idea that they have lost is because the media hype around them and also anger against the Akalis was catapulting them to form the govt. Their spokesman Raghav Chadha threatened to quit politics if AAP gets less than 85 seats in Punjab.In Goa 38 out of 40 candidates of AAP lost deposit .
One wag said after seeing the results in both these states " daru certainly effects liver but the brains do remain sharp "

UP is a stunner definitely.
UP voters are said to be the most politically savvy.They know that if work needs done then there has to be conjunction between centre and state.
And dalit politics is in bad taste.
We all are equal and Progress is the issue,not the caste.

Punjab had to go out of SADs hands as people were visibly most disappointed with it.
And another point one noticed was the younger generation not swayed by small gains in Punjab.
Hope India continues on the Path of Progress.

And one observers the local aap supporters trying to toe the middle class line.
Guess as Kejri ji says that voters can take money frm all but shd vote for aap. Civic Polls in Delhi is next.

You are absolutely correct that it deserves to be treated with contempt. In fact since the SC had outright rejected these "scurrilous" allegations and called for their deletion, I therefore intended to file a contempt petition in the SC against Mr. Ashutosh's act of filing these same Snoopgate allegations in the NCW to evade replying to my complaint about him making making outrageous sexual remarks about my deceased female ancestor.

I am now very reliably informed that Ms. Maneka Gandhi herself has intervened to instruct that my RTI is not to be replied to.


Had either my RTI been replied to or the NCW passed an order the case would have been different. But now any reasonable person would have reason to suspect something is fishy in Snoopgate matter and there must be some truth to the those "scurrillous allegations" levelled against Modi and Shah.

Because I am concerned in larger public interest that Mr. Ashutosh has wilfully committed contempt of certain directions of the Supreme Court which the Hon'ble Commission should promptly report to the Registrar of the Supreme Court, kindly provide me the following requested information

1) Certified copy of all written replies filed by Mr. Ashutosh to summons / notice issued to him by NCW.

2) Copy of all the videorecordings made by NCW whenever Mr. Ashutosh has appeared before the Honble Commission.

3) Action taken, if any, on Mr. Ashutoshs allegations / complaints against Mr.Amit Shah and Mr. Narendra Modi which Mr. Ashutosh submitted to the Honble Commission.

4) Information if it is true that the strange inaction by NCW to pass orders in the complaints against Mr. Ashutosh are because the matter is stalled by Mr. Ashutosh's counter complaints against Mr. Amit Shah and Mr. Narendra Modi.

5) Information if it is true that Mr. Ashutosh has also levelled allegations against Dr. Harsh Vardhan, a Union Minister, to the NCW.

I am constrained to observe that it is well over 4 months now since the last hearing in the subject complaint and yet there is no order of the Hon'ble Commission in this matter
for a complaint / counter-complaint alleging inter-alia sexual harassment by the present Prime Minister of India and the present President of the BJP Mr. Amit Shah made by Shri Ashutosh of Aam Aadmi Party.

 

To refresh your memory of this matter, (I am not giving the exact dates since these are on your file/s) you had summoned Mr. Ashutosh Gupta, National Spokesperson of Aam Aadmi Party, under NCW's statutory powers and which you announced on national television (Times Now) was based on my complaint against Ashutosh's outrageous and misogynistic article published by the "prestigious" news portal  NDTV.COM.

Accordingly, Mr. Ashutosh Gupta dutifully appeared before you, refsued to answer queries about his writings and and instead counter-complained about sexual harassments allegedly committed by Shri Narendra Modi and Shri Amit Shah, which allegations he tendered in writing along with certain electronic evidences.

Very shortly thereafter this hearing Shri Ashutosh gave a public statement outside NCW's office to the media saying that you had personally assured him that you would conduct an independent and fair inquiry into his complaint and would also summon Mr. Modi in the same way Ashutosh was summoned. Thereupon another NEWX reporter interviewed you on Mr.Ashutosh's statement in your office. I was also present during this interview and I have have my recording where you confirmed that Mr. Ashutosh's "complaint" against Mr. Modi / Mr. Shah would also be registered and sent to the NCW's Complaint and Investigation unit.  A video of your statement broadcast live by NEWSX is at URL

Thereafter when no order on my complaint was forthcoming, I sent you my reminder dt. 9.Oct.2016 and followed it up with an RTI request dated 25.Oct.2016 since I believed Mr. Ashutosh had committed criminal Contempt of the Supreme Court in your chambers. You had with great foresight officially videographed the proceedings. My RTI request is registered as no. MOWCD/R/2016/50635  dated 25.Oct.2016 and forwarded to your Commission by Shri V.S. Yadav (CPIO/MoWCD) very promptly. It is still not replied to.

In these circumstances wherein Institutions like the NCW and the DCW (Delhi Womens Commission) seem to be highly politicised paper tigers in the sense that NCW seemingly targets non-BJP politicians and the DCW Chairperson gets away with publicly imputing that one Dr. Harsh Vardhan (a BJP Union Minister) is running brothels on Delhi's GB Road, the complainants before you are fd up and constrained to give you final and clear warning to pass orders forthwith and dispose of the pending complaints against/by Mr. Ashutosh Gupta of Aam Aadmi Party.

In the alternative, I and the the INDIA AGAINST CORRUPTION jan andolan (to whom this email is being circulated) shall presume that no contempt has been committed by Mr. Ashutosh and that his allegations (NCW had summoned him in his capacity as Spokesperson Aam Aadmi Party) against Mr. Narendra Modi and Mr. Amit Shah in the "Snoopgate scandal" have been ascertained by NCW as being true and correct.

3) That although there was no such person as "Sarla Chaudhary" as described (which is probably a patently deliberate device devised by Ashutosh to claim she is a fictional character) it is obvious he is alluding to my deceased great-grand-aunt Sarala Debi Chaudhurani (who unfortunately has left behind no direct descendants to counter Ashutosh's calumny) using the despicable device of innuendo employed by gutter columnists.

4) I and my family are upset that NDTV.com website has published Ashutosh's distortions linking Mohandas Gandhi's sexual (masturbatory) fantasies to my deceased family members names to besmirch their iconic places in history. It is relevant to mention that Smt. Sarala Debi Chaudhurani is the pre-eminent feminist icon of India, prominent in nationalist and Congress circles and had written the musical score for both India's National Antem (ie. Jana Gana Mana) as well as the National song (ie. Bande Mataram). In fact these nation binding anthems were greatly popularised in Upper India by Smt. Sarala Debi of the highly nationalistic Adi Brahmo Samaj (a religious minority) of which I am an 'acharya' and an attack on Smt. Sarala Debi or Gurudev Rabindra Nath Tagore simply to defend a misogynistic sex-crazed rapist Minister is also an attack on our minority religion.

5) For your Eminence's information, Gandhi was never in India in 1910 (or even 1911, 1912, 1913....) whereas Pulitzer-Prize winning reporter Joseph Lelyveld writes that Gandhi was then (ie. since 1908) in a homo-erotic relationship with Hermann Kaltenbach in South Africa. Sarala Debi Chaudhurani.

 

6) Accordingly, I sincerely hope that Hon'ble Commission impleads me as a complainant and strongly indicts Shri Ashutosh Gupta and NDTV.com. I also seek permission to submit my evidence during proceedings as and when directed by your honor.

PS : I am a non-political person and am filing this in my personal capacity as a relative of Smt. Sarala Debi Chaudhurani (deceased) to defend her honour.
