My take :
 
Government needs to be congratulated for making process of selection of Information Commissioner open to public.
 
This has been long standing demand of RTI Activists.
 
The big question is ... will  the entire process of selection become transparent?
 
I recommend those who desire to apply for the post to send their application by Speed Post in addition to sending it by email. The movement of Speed Post letter can be tracked on Dept of Posts website. 
 
Remember on 10 Dec 2010, DoPT had issued a circular seeking public comments on proposed amendment to RTI
Rules by email...
 
After sending my comments I had followed it with an RTI seeking file details on which public views were being processed and had asked for attested hard copy of my comments sent by email. DoPT had not diariesd public comments in any file and could not show me the so called folder in which public comments placed as claimed by CPIO (DoPT).
 
When ever I checked with DoPT CPIO, I was told the said folder containing Public Comments "NOT TRACEBLE". The file on which the amendment to RTI rules was delibrated in DoPT had only NAC's comments.

Though most of parties, civil society groups and rights activists have condemned the brutal attack on senior advocate Prashant Bhushan, an overwhelming majority of them including Congress at one extreme and RSS at another have carefully chosen to dilute the tenor of their condemnation by adding an uncalled-for qualifying proviso to their respective statements. The said proviso, though differently worded by different groups, says that Mr.Prashant Bhushan shouldn't have spoken on the Kashmir issue the way he did a few days prior to the tragic incident. It was disturbing to notice that such commentators were overly concerned with the Kashmir issue at the moment, and not with the dirty violence perpetrated on Prashant Bhushan in his chamber in the premises of Supreme Court. It seemed, as if a plebiscite was being undertaken right under their nose in mainland India at that point of time and each of them asked to convey their opinion in the public domain for solving the much tangled Kashmir issue once and for all. On another plane it appeared as if Mr.Prashant Bhushan being the President or Prime Minister of India issued some unacceptable statement which if not shouted down instantly would plunge the whole nation into an irretrievable loss or ignominy. As a matter of fact, nothing of the sort happened. Mr.Bhushan in capacity of a citizen of India expressed certain views on Kashmir, which may not be acceptable to the Government, most political parties or quite many social outfits. But as guaranteed by his fundamental right to freedom of speech and expression under Article 19(1) of the Constitution, Mr.Bhushan or for that matter any citizen of the country is absolutely entitled to air his/her views on any matter if not explicitly subject to reasonable restrictions on the exercise of the said right to freedom as may be required under Article 19 (2) of the Constitution. Has the Government, legislature or judiciary of the country ever imposed any such restriction on the citizens' freedom of expression in respect of Kashmir issue? To our knowledge no and never ever. Then, the moot question arises, as the moment for squarely condemning a physical attack on a citizen's freedom of expression comes, why should one dilute his/her statement of condemnation by issuing an uncalled-for sermon as to what the victim shouldn't have said while exercising the freedom of expression? The real point at issue was whether the violent attack on Mr.Bhushan on the ground of his espousal of certain views on Kashmir was justified at all? Here the question relating to merit or demerit of his views didn't arise at all. Because, the Constitution by virtue of its Article 19(1) has empowered every citizen to speak on the merit or demerit of any position, irrespective of the consideration as to whether it conflicted with or was in sync with the official line or for that matter with any other line. It is a matter of great agony and anguish that even a highly learned veteran of Indian judiciary and the newly inducted Chairman of Press Council Justice Markandey Katzu in course of his recent walk-the-talk interview with Editor Indian Express did also qualify his condemnation of violence against Prashant Bhushan with an advisory that the latter shouldn't have spoken the way he did on Kashmir issue. Such qualifying remarks by Mr.Katzu against Prashant's observations on Kashmir did certainly dilute the tenor of his condemnation against the physical attack on Prashant Bhushan perpetrated by the goons in the guise of self-appointed patriots allegedly to curb his freedom of speech. It's painful to recall that such dastardly attacks undertaken by the muscle-flexing goons at the instance of fundamentalists on the citizens' freedom of speech around this or that issue, have taken place intermittently in last two decades. Attacks on the house of Arundhati Roy for her out-of-box remarks on Kashmir, on that of MF Hussain for his iconoclastic creations of art and the attack on Binayak Sen for his anti-Salwa Jhudum observations are a few recent instances of vicarious persecution by the civil society goons in connivance with the powers-that-be. The net result of such attacks on the great free thinkers of our country is a slow, but steady erosion of the very legitimacy of the constitutionally guaranteed freedom of speech and expression, on account of which India is slipping off into the murderous clutches of diehard fundamentalist and obscurantist forces. To safeguard India's destiny as a pluralist democracy, what is required at the moment is to give a try to Mr.Prashant Bhushan's proposal to ban and boycott those very outfits which in the name of 'nation' or 'religion' hold to ransom the citizens' freedom of expression, the foundational principle of any democracy worth the name.

 Since last few months,  there is an unprecedented development in rural Orissa that more and more people of disadvantaged communities  are coming forward to take up corrupt issues through using RTI in the state of Orissa.  Now RTI is not at all  a cup of tea for urban Middle Class. But  the common people at grass root level have come forward  to assert their right  to access the information and expose  the corruption  and  irregularities  through using RTI  and  taking   risk of life in their Endeavour of  enforcing  a transparent and accountable governance system  in the state. 
 
Mr. Braja Bihari Swain, aged about 66year, a retired employee of Orissa Forest Development Corporation,   in Nayagarh District of Orissa   is the president of 11Mouza Forest Protection Committee (an initiative by people of eleven villages for protecting the forest) for the year 2008 and 2009.  While interacting with the people, he came to know about a massive corruption in CAMPA fund and utilization of  Govt. Grants in Ranapur Forest Range.  He submitted RTI Application  to the PIO, office of Divisional Forest Officer, Khurda to  know the details of CAMPA project and fund allocated and utilized for the same. Tracing out  series of irregularities  in CAMPA project after  having gone through  the information supplied by DFO office, he submitted  a  petition to PCCF- Aranya Bhawan, DG-Vigilance, Govt. of Orissa, Secretary,  Department of  Forest and Environment and Divisonal Forest officer, Khurda for an enquiry and take legal action against the culprits. Being  greatly disturbed and terrified by the complaint petition,  the Range-Officer, Ranpur( Abhay Jena) and Forester, Sankhajodi Beat( Ramesh Chandra Jani) has registered a malicious and false case of illicit tree felling  against him and threatened   to murder   making him  as  co-accused with 18 professional timber mafias in Nayagarh district.
 
Information obtained under RTI  
  1. As per the Information obtained under RTI from Divisional Forest Office, Khurda dated 21/ 10/2010, around 10.58lakh rupees have been  spent for plantation in 64 hectare in Mal reserve forest.
  2. As per  Information supplied by DFO Khurda (Ranapur forest range office falls under this Division) dated 16th April 2011, around 4.34 lakh was spent for Plantation in 64 hectre in Mal Reserve Forest.
 
  1. The above two information do not match each other though both the reports are furnished by the same Office. This variation gives a fishy smell in the whole affairs of plantation in the area.
 
  1.  That as per the information supplied by DFO Khurda dated 12th May 2011 where they have supplied 15 cash voucher copies which amounts to around 3.77lakh rupees and this information was given against our question on all the cash voucher copies of the amount of 4.34lakh spent for plantation in 64 hectare in mal reserve forest. In addition to this two cash vouchers vide 87 ® 7/10 and 88( r) 7/10 that amounts to Rs 68,400  were not counter signed by the concerned Range Officer and passed by the DFO Khurda. This shows that the amounts they have been claiming to be spent are not in the vouchers and secondly the DFO has not sincerely examined while signing the Vouchers.
 
  About the False case:
AS per the FIR No 150/11filed dated 10.9. 2011  by Forest Ranger,  Charges  have been leveled against him  under section 294/379/506/149 of IPC and section 25 and 27 of Arms Act. In the above case he has  been made co-accused  along with other 18 members. The intention of filling this case  is to harass him and desist him  from filing complaints and RTI applications against the Ranpur Range Officer. As he was instrumental in filing the RTI applications and petitions, they had targeted him  by filing a false case. At any time, the police may arrest him.
 
 Now he has filed a petition to Orissa Information Commission and Orissa Human Rights Commission  praying for an enquiry into the matter  and  give him justice.

This is rather unfortunate.

RTI delivery is flawed with manual processing which is discretionary too some time. Promulgating RTI Act is necessary but not sufficient. The completeness of RTI Act needs to be achieved by its delivery process through e governance. Please refer my couple of mails earlier. 

We are going to see the same deficiencies even if we get the best of Lok Pals and Lok Ayuktas.

Out of the three layers of governance Vital, Essential and Desirable (VED), V is made up of politicians and babus, E is made up of police, judges, CBI, CVC etc and D is all the rest.

V layer the most important and heaviest of all is mostly corrupt and is stinking in India. The moment e governance addresses the functions of   V layer, this would become 90 % corruption free. E and D layers will simply follow in the foot steps of V layer as shear weight of V layer will pull them through and take them along a good path. 

Just to re-iterate, all 40 developed countries have their V layer functions performed mostly through e governance.

We need to continue with our efforts to improve the delivery of RTI and press for e governance in a time bound manner.

  About the False case:
AS per the FIR No 150/11filed dated 10.9. 2011  by Forest Ranger,  Charges  have been leveled against him  under section 294/379/506/149 of IPC and section 25 and 27 of Arms Act. In the above case he has  been made co-accused  along with other 18 members. The intention of filling this case  is to harass him and desist him  from filing complaints and RTI applications against the Ranpur Range Officer. As he was instrumental in filing the RTI applications and petitions, they had targeted him  by filing a false case. At any time, the police may arrest him.
 
 Now he has filed a petition to Orissa Information Commission and Orissa Human Rights Commission  praying for an enquiry into the matter  and  give him justice.

 Since last few months,  there is an unprecedented development in rural Orissa that more and more people of disadvantaged communities  are coming forward to take up corrupt issues through using RTI in the state of Orissa.  Now RTI is not at all  a cup of tea for urban Middle Class. But  the common people at grass root level have come forward  to assert their right  to access the information and expose  the corruption  and  irregularities  through using RTI  and  taking   risk of life in their Endeavour of  enforcing  a transparent and accountable governance system  in the state. 

 

Mr. Braja Bihari Swain, aged about 66year, a retired employee of Orissa Forest Development Corporation,   in Nayagarh District of Orissa   is the president of 11Mouza Forest Protection Committee (an initiative by people of eleven villages for protecting the forest) for the year 2008 and 2009.  While interacting with the people, he came to know about a massive corruption in CAMPA fund and utilization of  Govt. Grants in Ranapur Forest Range.  He submitted RTI Application  to the PIO, office of Divisional Forest Officer, Khurda to  know the details of CAMPA project and fund allocated and utilized for the same. Tracing out  series of irregularities  in CAMPA project after  having gone through  the information supplied by DFO office, he submitted  a  petition to PCCF- Aranya Bhawan, DG-Vigilance, Govt. of Orissa, Secretary,  Department of  Forest and Environment and Divisonal Forest officer, Khurda for an enquiry and take legal action against the culprits. Being  greatly disturbed and terrified by the complaint petition,  the Range-Officer, Ranpur( Abhay Jena) and Forester, Sankhajodi Beat( Ramesh Chandra Jani) has registered a malicious and false case of illicit tree felling  against him and threatened   to murder   making him  as  co-accused with 18 professional timber mafias in Nayagarh district.

 

Information obtained under RTI  

  1. As per the Information obtained under RTI from Divisional Forest Office, Khurda dated 21/ 10/2010, around 10.58lakh rupees have been  spent for plantation in 64 hectare in Mal reserve forest.
  2. As per  Information supplied by DFO Khurda (Ranapur forest range office falls under this Division) dated 16th April 2011, around 4.34 lakh was spent for Plantation in 64 hectre in Mal Reserve Forest.

 

  1. The above two information do not match each other though both the reports are furnished by the same Office. This variation gives a fishy smell in the whole affairs of plantation in the area.

 

  1.  That as per the information supplied by DFO Khurda dated 12th May 2011 where they have supplied 15 cash voucher copies which amounts to around 3.77lakh rupees and this information was given against our question on all the cash voucher copies of the amount of 4.34lakh spent for plantation in 64 hectare in mal reserve forest. In addition to this two cash vouchers vide 87 ® 7/10 and 88( r) 7/10 that amounts to Rs 68,400  were not counter signed by the concerned Range Officer and passed by the DFO Khurda. This shows that the amounts they have been claiming to be spent are not in the vouchers and secondly the DFO has not sincerely examined while signing the Vouchers.

Dear Shashikumar,

The Whistle Blower Act is for the Govt Officials who expose corruption
in their Department. Where as the RTI Activists are the outside
persons like journalists who expose the corruption. Hence they have
protect themselves just how the Media protects them self from Demation
and Contempt Proceedings.

You realy feel that RTI Activists need protection, then all the RTI
Activists of the Bangalore (atleast) should uninit together.

But it has failed so many times in Bangalore, because of their Egostic
Approach, Not Maintaining Transperency among them selves and Not
sharing the Information what they have obtained under RTI.

Instead they pay bribe to the PIO's of Rs. 500 per month get the RTI
application copies, duplicate them by sending the same application
intheir own name.

So RTI Activists are back stabing the genuine RTI Activists in Bangalore.

Opposing the move to dilute the RTI Act, BJP leader LK Advani on Saturday said Prime Minister Manmohan Singh's talk of a relook at the Act could be due to "sharp" differences between some of his ministers giving the impression of a "civil war" within the government.
 
"I see no reason for the talk of a critical relook at the RTI except for the fact that differences between (Union ministers) Pranab Mukherjee and Chidambaram came to fore very sharply and gave the impression of a civil war going on within the government. That is the only reason for the anger of Prime Minister against RTI," he told reporters here.
 
BJP was totally opposed to any move to dilute the Act, through which some of the major corruption cases had come to light, he said.
 
UPA government, which claimed RTI as one of its major achievements, was now trying to have a relook at it as certain corruption exposes had materialised through the RTI itself, Advani said. "We are opposed to any change of any kind in the RTI law," he said.
 
Asked if the BJP had the moral standing to take on the Congress on corruption when former Karnataka chief minister BS Yeddyurappa ....................
